These Directors, along with the social workers acting under their authority, are tasked with enforcing the <a href=\"https:\/\/www.legisquebec.gouv.qc.ca\/en\/document\/cs\/P-34.1\">Youth Protection Act<\/a>. <\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;4.27.4&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]Adopted in 1977, the Youth Protection Act aims to protect children who are in situations where their safety or development is, or may be, considered at risk. <\/p>\n<p>These so-called \u201ccompromised situations\u201d are listed and described in the Youth Protection Act. <\/p>\n<p>Thus, the DYP will intervene in the life of a child and their family if, after assessment, it determines that the child is experiencing one or more compromised situations.[\/et_pb_text][et_pb_text _builder_version=&#8221;4.27.4&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<p style=\"font-weight: 400;\">The main grounds for intervention listed in the <em>Youth Protection Act<\/em> are<em>:<\/em><\/p>\n<ul>\n<li>Abandonment;<\/li>\n<li>Neglect:\n<ul>\n<li>Physical and\/or;<\/li>\n<li>Health-related and\/or;<\/li>\n<li>Educational;<\/li>\n<\/ul>\n<\/li>\n<li>A serious risk of neglect;<\/li>\n<li>Psychological abuse;<\/li>\n<li>Direct or indirect exposure to domestic violence;<\/li>\n<li>Sexual abuse or if the child is at serious risk of experiencing sexual abuse;<\/li>\n<li>Physical abuse or if the child is at serious risk of experiencing physical abuse;<\/li>\n<li>If the child has serious behavioural disorders.<\/li>\n<\/ul>\n<p>[\/et_pb_text][et_pb_heading title=&#8221;General Principles of the Law and Your Rights&#8221; _builder_version=&#8221;4.27.4&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;][\/et_pb_heading][et_pb_text _builder_version=&#8221;4.27.4&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h3>The best interests of the child<\/h3>\n<p>The concept of the best interests of the child and the respect for their rights form the basis of all decisions made concerning them throughout the duration of the DYP intervention. <\/p>\n<p>The Youth Protection Act does not provide a formal definition of the best interests of the child. However, it outlines broad guidelines that help clarify what constitutes the child\u2019s best interests and guide the various actors involved in the intervention when making decisions.[\/et_pb_text][et_pb_text _builder_version=&#8221;4.27.4&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<p style=\"font-weight: 400;\">First, the following factors are taken into consideration:<\/p>\n<ul>\n<li>The child\u2019s moral, intellectual, and emotional needs;<\/li>\n<li>The child\u2019s age;<\/li>\n<li>The child\u2019s health;<\/li>\n<li>The child\u2019s character;<\/li>\n<li>The child\u2019s family environment, including the socio-economic conditions in which they live;<\/li>\n<li>Other aspects specific to the child\u2019s situation;<\/li>\n<\/ul>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;4.27.4&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<p style=\"font-weight: 400;\">Next, any decision concerning a child must ensure, among other things:<\/p>\n<ul>\n<li>Continuity in the care they receive;<\/li>\n<li>Stability in the child\u2019s relationships;<\/li>\n<li>That the child\u2019s living conditions are appropriate to their needs.<\/li>\n<\/ul>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;4.27.4&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]As a general rule, keeping the child within their family should be prioritized, provided that it is in their best interest.[\/et_pb_text][et_pb_text _builder_version=&#8221;4.27.4&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]Finally, the concept of the child\u2019s best interests may sometimes conflict with the wishes of the child or their family. <\/p>\n<p>In case of conflict, differing views on what constitutes the child\u2019s best interests are brought before the Youth Court. It is then up to the judge to determine what is in the child\u2019s best interests based on the evidence presented. [\/et_pb_text][et_pb_text _builder_version=&#8221;4.27.4&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h3>Your Rights<\/h3>\n<p style=\"font-weight: 400;\">The <em>Youth Protection Act <\/em>not only regulates the intervention of the DYP but also establishes rights for the child and their parents. Here are some of them: <\/p>\n<ul>\n<li>The child and their parents have the right to be treated with courtesy, fairness, and understanding;<\/li>\n<\/ul>\n<ul>\n<li>The family\u2019s cultural characteristics must be taken into account by the various professionals involved, especially if the family belongs to an Indigenous community;<\/li>\n<\/ul>\n<ul>\n<li>The right to be informed and consulted throughout the DYP intervention;<\/li>\n<\/ul>\n<ul>\n<li>The right to consult with and be represented by a <a href=\"https:\/\/www.sabbagh.ca\/en\/\">lawyer<\/a>;<\/li>\n<\/ul>\n<ul>\n<li>The right to challenge the decisions of the DYP;<\/li>\n<\/ul>\n<ul>\n<li>The right to be heard, including before the Youth Court;<\/li>\n<\/ul>\n<ul>\n<li>The right to be assisted by a person of their choice when meeting with the DYP;<\/li>\n<\/ul>\n<ul>\n<li>The right to receive adequate health and social services;<\/li>\n<\/ul>\n<ul>\n<li>The child has the right to receive appropriate educational services;<\/li>\n<\/ul>\n<p>[\/et_pb_text][et_pb_heading title=&#8221;How the DYP Operates: The Start of the Intervention&#8221; _builder_version=&#8221;4.27.4&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;][\/et_pb_heading][et_pb_text _builder_version=&#8221;4.27.4&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h2>Reporting to the DYP: The Purpose of the Intervention<\/h2>\n<p>The DYP intervenes only based on reports it receives. <\/p>\n<p>Anyone with concerns about a child\u2019s situation can report to the DYP, especially professionals who provide care or services to children (doctors, healthcare workers, teachers, police officers, etc.). <\/p>\n<p>These various professionals are required to report if they have reasonable grounds to believe that a child is in a compromised situation. <\/p>\n<p>In all cases, anyone who has reasonable grounds to believe that a child\u2019s safety or development is at risk due to sexual or physical abuse\u2014or the risk thereof\u2014must report the situation to the DYP.<br \/>\nThe identity of the person making the report is kept confidential.<\/p>\n<p>In short, without a report, the DYP cannot intervene. [\/et_pb_text][et_pb_text _builder_version=&#8221;4.27.4&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h2>Retention of the report<\/h2>\n<p>Upon receiving a report, the DYP conducts a preliminary assessment of the situation and determines whether the report should be accepted or not.<\/p>\n<p>If the DYP <strong>does not accept<\/strong> the report, the intervention ends, but services and resources may still be offered to the child and their family.<\/p>\n<p>If the DYP <strong>accepts<\/strong> the report, it initiates an investigation and then carries out a more comprehensive <strong>assessment<\/strong> of the child\u2019s situation.<\/p>\n<p>Additionally, the DYP may take measures to protect the child in emergency situations, such as immediate protective actions or requesting a temporary order from the Youth Court.<\/p>\n<p>[\/et_pb_text][et_pb_text _builder_version=&#8221;4.27.4&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]Click the following link to access Part Two: Learn More[\/et_pb_text][et_pb_text _builder_version=&#8221;4.27.4&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<p><strong>NOTE:<\/strong> This article does not constitute legal advice or legal opinion.
